Eine Nutzung der Internetseiten der BOLD & EPIC Transform GmbH ist grundsätzlich ohne jede Angabe personenbezogener Daten möglich. Sofern eine betroffene Person besondere Services unseres Unternehmens über unsere Internetseite in Anspruch nehmen möchte, könnte jedoch eine Verarbeitung personenbezogener Daten erforderlich werden. Ferner werden betroffene Personen mittels dieser Datenschutzerklärung über die ihnen zustehenden Rechte aufgeklärt.
The BOLD & EPIC Transform GmbH hat als für die Verarbeitung Verantwortlicher zahlreiche technische und organisatorische Maßnahmen umgesetzt, um einen möglichst lückenlosen Schutz der über diese Internetseite verarbeiteten personenbezogenen Daten sicherzustellen. Dennoch können Internetbasierte Datenübertragungen grundsätzlich Sicherheitslücken aufweisen, sodass ein absoluter Schutz nicht gewährleistet werden kann. Aus diesem Grund steht es jeder betroffenen Person frei, personenbezogene Daten auch auf alternativen Wegen, beispielsweise telefonisch, an uns zu übermitteln.
1 | Definitions
Die Datenschutzerklärung der BOLD & EPIC Transform GmbH beruht auf den Begrifflichkeiten, die durch den Europäischen Richtlinien- und Verordnungsgeber beim Erlass der Datenschutz-Grundverordnung (DS-GVO) verwendet wurden. Unsere Datenschutzerklärung soll sowohl für die Öffentlichkeit als auch für unsere Kunden und Geschäftspartner einfach lesbar und verständlich sein. Um dies zu gewährleisten, möchten wir vorab die verwendeten Begrifflichkeiten erläutern.
We use the following terms, among others, in this data protection declaration:
a) personenbezogene Daten
Personal data means any information relating to an identified or identifiable natural person (hereinafter referred to as "data subject"). An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, online identification, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person.
b) betroffene Person
An affected individual means any identified or identifiable natural person whose personal data is processed by the controller.
c) Verarbeitung
Processing is any operation or set of operations, whether or not performed by automated means, which is performed upon personal data, such as collection, recording, organization, filing, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination, or otherwise making available, alignment or combination, restriction, erasure, or destruction.
d) Einschränkung der Verarbeitung
Restriction of processing is the marking of stored personal data with the aim of limiting their future processing.
e) Profiling
Profiling is any automated processing of personal data consisting of the use of such personal data to evaluate certain personal aspects relating to a natural person, in particular to analyze or predict aspects relating to the job performance, economic situation, health, personal preferences, interests, reliability, conduct, location, or change of location of that natural person.
f) Pseudonymisierung
Pseudonymization is the processing of personal data in such a way that the personal data can no longer be attributed to a specific data subject without the use of additional information, provided that this additional information is kept separately and is subject to technical and organizational measures that ensure that the personal data is not attributed to an identified or identifiable natural person.
g) Verantwortlicher oder für die Verarbeitung Verantwortlicher
A controller, or data controller, is a natural or legal person, public authority, agency, or any other body that, alone or jointly with others, determines the purposes and means of the processing of personal data. Where the purposes and means of such processing are determined by Union or national law, provision may be made for the controller or for the specific criteria for his or her designation in accordance with Union or national law.
h) Auftragsverarbeiter
A processor is a natural or legal person, public authority, agency, or other body that processes personal data on behalf of the controller.
i) Empfänger
The recipient is any natural or legal person, public authority, agency, or other body to whom personal data is disclosed, whether or not that person is a third party. However, authorities that may receive personal data in the context of a specific investigation mandate under Union or national law shall not be considered recipients.
j) Dritter
A third party is a natural or legal person, public authority, agency, or body other than the data subject, the controller, the processor, and the persons who, under the direct authority of the controller or the processor, are authorized to process the personal data.
k) Einwilligung
Consent shall mean any freely given, informed, and unequivocal expression of the data subject's will in a specific case, in the form of a statement or any other unequivocal affirmative act by which the data subject signifies his or her consent to the processing of personal data relating to him or her.

04 | Collection of general data and information
Die Internetseite der BOLD & EPIC Transform GmbH erfasst mit jedem Aufruf der Internetseite durch eine betroffene Person oder ein automatisiertes System eine Reihe von allgemeinen Daten und Informationen. Diese allgemeinen Daten und Informationen werden in den Logfiles des Servers gespeichert. Erfasst werden können die (1) verwendeten Browsertypen und Versionen, (2) das vom zugreifenden System verwendete Betriebssystem, (3) die Internetseite, von welcher ein zugreifendes System auf unsere Internetseite gelangt (sogenannte Referrer), (4) die Unterwebseiten, welche über ein zugreifendes System auf unserer Internetseite angesteuert werden, (5) das Datum und die Uhrzeit eines Zugriffs auf die Internetseite, (6) eine Internet-Protokoll-Adresse (IP-Adresse), (7) der Internet-Service-Provider des zugreifenden Systems und (8) sonstige ähnliche Daten und Informationen, die der Gefahrenabwehr im Falle von Angriffen auf unsere informationstechnologischen Systeme dienen.
Bei der Nutzung dieser allgemeinen Daten und Informationen zieht die BOLD & EPIC Transform GmbH keine Rückschlüsse auf die betroffene Person. Diese Informationen werden vielmehr benötigt, um (1) die Inhalte unserer Internetseite korrekt auszuliefern, (2) die Inhalte unserer Internetseite sowie die Werbung für diese zu optimieren, (3) die dauerhafte Funktionsfähigkeit unserer informationstechnologischen Systeme und der Technik unserer Internetseite zu gewährleisten sowie (4) um Strafverfolgungsbehörden im Falle eines Cyberangriffes die zur Strafverfolgung notwendigen Informationen bereitzustellen. Diese anonym erhobenen Daten und Informationen werden durch die BOLD & EPIC Transform GmbH daher einerseits statistisch und ferner mit dem Ziel ausgewertet, den Datenschutz und die Datensicherheit in unserem Unternehmen zu erhöhen, um letztlich ein optimales Schutzniveau für die von uns verarbeiteten personenbezogenen Daten sicherzustellen. Die anonymen Daten der Server-Logfiles werden getrennt von allen durch eine betroffene Person angegebenen personenbezogenen Daten gespeichert.
05 | Routine deletion and blocking of personal data
The controller shall process and store personal data relating to the data subject only for the period of time necessary to achieve the purpose of storage or where provided for by the European legislator or other legislator in laws or regulations to which the controller is subject.
If the purpose of storage ceases to apply or if a storage period prescribed by the European Directives and Regulations or any other competent legislator expires, the personal data will be blocked or deleted as a matter of routine and in accordance with legal requirements.
06 | Rights of the data subject
a) Recht auf Bestätigung
Every data subject has the right, granted by the European Directive and Regulation, to obtain from the controller confirmation as to whether personal data relating to him or her is being processed. If a data subject wishes to exercise this right of confirmation, he or she may at any time contact an employee of the controller.
b) Recht auf Auskunft
Any person affected by the processing of personal data has the right, granted by the European Directives and Regulations, to obtain at any time and free of charge from the data controller information on personal data relating to him or her and a copy thereof. The European Data Protection Supervisor has also granted the data subject access to the following information:
- the processing purposes
- the categories of personal data processed
- the recipients or categories of recipients to whom the personal data have been or will be disclosed, in particular recipients in third countries or international organizations
- if possible, the planned duration for which the personal data will be stored, or, if this is not possible, the criteria for determining this duration
- the existence of a right of rectification or erasure of personal data relating to him or her, of a restriction on processing by the controller, or of a right to object to such processing
- the existence of a right of appeal to a supervisory authority
- if the personal data are not collected from the data subject: All available information on the origin of the data
- the existence of automated decision-making, including profiling, in accordance with Article 22(1) and (4) of the DPA and, at least in these cases, meaningful information on the logic involved and the scope and intended impact of such processing on the data subject
- The data subject shall also have the right to obtain information as to whether personal data has been transferred to a third country or to an international organization. If this is the case, the data subject shall also have the right to obtain information on the appropriate safeguards relating to the transfer
If a data subject wishes to exercise this right of access, he or she may at any time contact an employee of the controller.
c) Recht auf Berichtigung
Any person affected by the processing of personal data has the right, granted by the European legislator, to request the rectification without delay of inaccurate personal data concerning him. The data subject shall also have the right to obtain the completion of incomplete personal data, including by means of a supplementary declaration, having regard to the purposes of the processing.
If a data subject wishes to exercise this right of access, he or she may at any time contact an employee of the controller.
d) Recht auf Löschung (Recht auf Vergessen werden)
Any person affected by the processing of personal data has the right, granted by the European Directives and Regulations, to obtain from the controller the immediate erasure of personal data relating to him or her if one of the following reasons applies, provided that the processing is not necessary:
- The personal data has been collected or otherwise processed for purposes for which it is no longer necessary.
- The data subject withdraws the consent on which the processing was based pursuant to Article 6(1)(a) of the DPA or Article 9(2)(a) of the DPA, and there is no other legal basis for the processing.
- The data subject lodges an objection to the processing pursuant to Article 21(1) of the DPA and there are no overriding legitimate reasons for processing, or the data subject lodges an objection to the processing pursuant to Article 21(2) of the DPA.
- The personal data was processed unlawfully.
- The deletion of personal data is necessary to comply with a legal obligation under Union law or the law of the Member States to which the controller is subject.
- The personal data was collected in relation to information society services offered, in accordance with Article 8(1) of the GDPR.
Sofern einer der oben genannten Gründe zutrifft und eine betroffene Person die Löschung von personenbezogenen Daten, die bei der BOLD & EPIC Transform GmbH gespeichert sind, veranlassen möchte, kann sie sich hierzu jederzeit an einen Mitarbeiter des für die Verarbeitung Verantwortlichen wenden. Der Mitarbeiter der BOLD & EPIC Transform GmbH wird veranlassen, dass dem Löschverlangen unverzüglich nachgekommen wird.
Wurden die personenbezogenen Daten von der BOLD & EPIC Transform GmbH öffentlich gemacht und ist unser Unternehmen als Verantwortlicher gemäß Art. 17 Abs. 1 DS-GVO zur Löschung der personenbezogenen Daten verpflichtet, so trifft die BOLD & EPIC Transform GmbH unter Berücksichtigung der verfügbaren Technologie und der Implementierungskosten angemessene Maßnahmen, auch technischer Art, um andere für die Datenverarbeitung Verantwortliche, welche die veröffentlichten personenbezogenen Daten verarbeiten, darüber in Kenntnis zu setzen, dass die betroffene Person von diesen anderen für die Datenverarbeitung Verantwortlichen die Löschung sämtlicher Links zu diesen personenbezogenen Daten oder von Kopien oder Replikationen dieser personenbezogenen Daten verlangt hat, soweit die Verarbeitung nicht erforderlich ist. Der Mitarbeiter der Incedo Services GmbH wird im Einzelfall das Notwendige veranlassen.
e) Recht auf Einschränkung der Verarbeitung
Any person affected by the processing of personal data has the right, granted by the European Directives and Regulations, to obtain from the controller the restriction of processing if one of the following conditions is met:
- The accuracy of the personal data is contested by the data subject for a period of time sufficient to enable the controller to verify the accuracy of the personal data.
- The processing is unlawful; the data subject refuses to have the personal data deleted and instead requests a restriction on the use of the personal data.
- The controller no longer needs the personal data for the purposes of processing it, but the data subject needs it in order to assert, exercise, or defend legal claims.
- The data subject has lodged an objection to the processing pursuant to Article 21(1) of the DPA, and it is not yet clear whether the legitimate reasons of the controller outweigh those of the data subject.
Sofern eine der oben genannten Voraussetzungen gegeben ist und eine betroffene Person die Einschränkung von personenbezogenen Daten, die bei der BOLD & EPIC Transform GmbH gespeichert sind, verlangen möchte, kann sie sich hierzu jederzeit an einen Mitarbeiter des für die Verarbeitung Verantwortlichen wenden. Der Mitarbeiter der BOLD & EPIC Transform GmbH wird die Einschränkung der Verarbeitung veranlassen.
f) Recht auf Datenübertragbarkeit
Any person affected by the processing of personal data has the right, granted by the European Directive and Regulation Giver, to receive the personal data concerning him or her, which have been provided by the data subject to a controller, in a structured, common, and machine-readable format. He or she also has the right to have this data communicated to another controller without hindrance by the controller to whom the personal data has been made available, provided that the processing is based on consent pursuant to Article 6 paragraph 1 letter a DPA or Article 9 paragraph 2 letter a DPA or on a contract pursuant to Article 6 paragraph 1 letter b DPA and that the processing is carried out by means of automated procedures, unless the processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.
Furthermore, when exercising their right to data transfer pursuant to Art. 20 Para. 1 DPA, the data subject has the right to request that personal data be transferred directly from one controller to another controller, insofar as this is technically feasible and provided that this does not adversely affect the rights and freedoms of other persons.
Zur Geltendmachung des Rechts auf Datenübertragbarkeit kann sich die betroffene Person jederzeit an einen Mitarbeiter der BOLD & EPIC Transform GmbH wenden.
g) Recht auf Widerspruch
Every person concerned by the processing of personal data has the right, granted by the European legislator, to object at any time, for reasons arising from his or her particular situation, to the processing of personal data concerning him or her carried out pursuant to Article 6(1)(e) or (f) of the DPA. This also applies to profiling based on these provisions.
The BOLD & EPIC Transform GmbH verarbeitet die personenbezogenen Daten im Falle des Widerspruchs nicht mehr, es sei denn, wir können zwingende schutzwürdige Gründe für die Verarbeitung nachweisen, die den Interessen, Rechten und Freiheiten der betroffenen Person überwiegen, oder die Verarbeitung dient der Geltendmachung, Ausübung oder Verteidigung von Rechtsansprüchen.
Verarbeitet die BOLD & EPIC Transform GmbH personenbezogene Daten, um Direktwerbung zu betreiben, so hat die betroffene Person das Recht, jederzeit Widerspruch gegen die Verarbeitung der personenbezogenen Daten zum Zwecke derartiger Werbung einzulegen. Dies gilt auch für das Profiling, soweit es mit solcher Direktwerbung in Verbindung steht. Widerspricht die betroffene Person gegenüber der BOLD & EPIC Transform GmbH der Verarbeitung für Zwecke der Direktwerbung, so wird die BOLD & EPIC Transform GmbH die personenbezogenen Daten nicht mehr für diese Zwecke verarbeiten.
Zudem hat die betroffene Person das Recht, aus Gründen, die sich aus ihrer besonderen Situation ergeben, gegen die sie betreffende Verarbeitung personenbezogener Daten, die bei der BOLD & EPIC Transform GmbH zu wissenschaftlichen oder historischen Forschungszwecken oder zu statistischen Zwecken gemäß Art. 89 Abs. 1 DS-GVO erfolgen, Widerspruch einzulegen, es sei denn, eine solche Verarbeitung ist zur Erfüllung einer im öffentlichen Interesse liegenden Aufgabe erforderlich.
Zur Ausübung des Rechts auf Widerspruch kann sich die betroffene Person direkt jeden Mitarbeiter der BOLD & EPIC Transform GmbH oder einen anderen Mitarbeiter wenden. Der betroffenen Person steht es ferner frei, im Zusammenhang mit der Nutzung von Diensten der Informationsgesellschaft, ungeachtet der Richtlinie 2002/58/EG, ihr Widerspruchsrecht mittels automatisierter Verfahren auszuüben, bei denen technische Spezifikationen verwendet werden.
h) Automatisierte Entscheidungen im Einzelfall einschließlich Profiling
Every person concerned by the processing of personal data has the right, granted by the European legislator, not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning him/her or significantly affects him/her in a similar way, provided that the decision (1) is not necessary for the conclusion or performance of a contract between the data subject and the controller, or (2) is authorised by Union or national legislation to which the controller is subject and such legislation provides for adequate measures to safeguard the rights and freedoms and legitimate interests of the data subject, or (3) is made with the explicit consent of the data subject.
Ist die Entscheidung (1) für den Abschluss oder die Erfüllung eines Vertrags zwischen der betroffenen Person und dem Verantwortlichen erforderlich oder (2) erfolgt sie mit ausdrücklicher Einwilligung der betroffenen Person, trifft die BOLD & EPIC Transform GmbH angemessene Maßnahmen, um die Rechte und Freiheiten sowie die berechtigten Interessen der betroffenen Person zu wahren, wozu mindestens das Recht auf Erwirkung des Eingreifens einer Person seitens des Verantwortlichen, auf Darlegung des eigenen Standpunkts und auf Anfechtung der Entscheidung gehört.
If the data subject wishes to exercise rights relating to automated decisions, he or she may at any time contact an employee of the controller.
i) Recht auf Widerruf einer datenschutzrechtlichen Einwilligung
Every person affected by the processing of personal data has the right, granted by the European Directive and Regulation Giver, to revoke his or her consent to the processing of personal data at any time.
If the data subject wishes to exercise his or her right to withdraw consent, he or she may at any time contact an employee of the controller.
07 | Legal basis of the processing
Art. 6 I lit. a GDPR serves our company as a legal basis for processing operations for which we obtain consent for a specific processing purpose. If the processing of personal data is necessary for the performance of a contract to which the data subject is a party, as is the case, for example, with processing operations necessary for the supply of goods or provision of other services or consideration, the processing is based on Art. 6 I lit. b GDPR. The same applies to processing operations that are necessary to carry out pre-contractual measures, for example, in cases of inquiries about our products or services. If our company is subject to a legal obligation that makes it necessary to process personal data, for example, to fulfill tax obligations, processing is based on Art. 6 I lit. c GDPR. In rare cases, the processing of personal data may be necessary to protect the vital interests of the data subject or another natural person. This would be the case, for example, if a visitor to our company were to be injured and his or her name, age, health insurance details, or other vital information had to be disclosed to a doctor, hospital, or other third party. In this case, the processing would be based on Art. 6 I lit. d GDPR. Finally, processing operations could be based on Art. 6 I lit. f GDPR. Processing operations that are not covered by any of the aforementioned legal bases are based on this legal basis if the processing is necessary to safeguard a legitimate interest of our company or of a third party, unless the interests, fundamental rights, and freedoms of the data subject prevail. We are permitted to carry out such processing operations, in particular, because they have been specifically mentioned by the European legislator. In this respect, it took the view that a legitimate interest could be assumed if the data subject is a customer of the controller (Recital 47, sentence 2 GDPR).
08 | Legitimate interests in the processing pursued by the controller or a third party
If the processing of personal data is based on Article 6 I lit. f GDPR, our legitimate interest is to carry out our business activities for the benefit of the well-being of all our employees and our shareholders.
09 | Duration for which the personal data are stored
The criterion for the duration of storage of personal data is the respective legal retention period. After the expiration of the period, the corresponding data is routinely deleted, provided that it is no longer required for the fulfillment or initiation of the contract.
10 | Legal or contractual provisions providing the personal data; necessity for the conclusion of the contract; obligation of the data subject to provide the personal data; possible consequences of not providing the data
We would like to inform you that the provision of personal data is partly required by law (e.g., tax regulations) or can also result from contractual regulations (e.g., information on the contractual partner). Sometimes it may be necessary for a contract to be concluded that a data subject provides us with personal data, which must subsequently be processed by us. For example, the data subject is obliged to provide us with personal data if our company concludes a contract with him or her. Failure to provide the personal data would mean that the contract with the data subject could not be concluded. Before the person concerned makes personal data available, the person concerned must contact one of our employees. Our employee will inform the data subject on a case-by-case basis whether the provision of the personal data is required by law or contract or necessary for the conclusion of the contract, whether there is an obligation to provide the personal data, and what the consequences would be if the personal data were not provided.
11 | Existence of automated decision making
As a responsible company, we avoid automatic decision making or profiling.
